URGENT! You can make a difference. . . . Bobby Russell, recently interviewed [Update, October 2016: the new link is HERE] by “How Positive Are You” co-host David Crowe on his “The Infectious Myth” show, is raising funds to appeal the September 15, 2014, dismissal on summary judgment of his medical malpractice suit against the University of Kentucky Medical Center and doctors. This system has an effective monopoly on “HIV/AIDS” testing and treatment in eastern Kentucky but no accountability to patients on how reliable those tests are. They misdiagnosed Bobby as “HIV positive” for eight years. He needs to raise $9,000 by September 29 toward a total of $25,000 by the end of the year, and has set up an online fundraising appeal here. Please give what you can. [Note, October 22, 2014: The new deadline to file a Notice of Appeal is October 29. The amount of money Bobby needs changes daily, but we hope that you will still consider giving to Bobby’s legal fund. Bobby has also created a Web site to “Protest the Test,” where you can learn more and become part of this historic effort to challenge careless HIV testing.]
We hope you will agree that this lawsuit is important. Basically, Kentucky says that persons with “HIV-positive” test results (explained in Episode 6 and again in Episode 82) must contest these results within a year, even if doctors and other clinicians tell them that they are “in denial” and must be referred for psychiatric evaluation for even thinking the results might be contestable.
Until this Kafka-esque decision is overturned, we advise you, no matter what state or country you live in, to document your “diagnosis” by using the services of a licensed investigative agency or following do-it-yourself letter-writing instructions (see “Creating a Paper Trail”) without delay. Even if you do not find a way to erase your HIV status from state databases now, you will have done the legwork. Good luck!
We plan to put Bobby, and possibly his lawyer, on HPAY again in the next few days. The case was previously featured in Episode 76.
UPDATE: Bobby Russell filed his Notice of Appeal on October 29, 2014, the deadline for commencing an appeal on the dismissal on summary judgment. Contrary to rumors that the case was dismissed on the merits, it remains appealable on Statute of Limitations grounds (timely filing of a lawsuit after finding wrongdoing), and is being appealed with assistance of counsel. Thanks to all those who contributed to Bobby’s GoFundMe campaign. Bobby still needs money to keep this process going forward, so please give what you can by clicking here.
